Interdistrict Transfer/Reciprocal Agreement
An interdistrict transfer/reciprocal agreement is when parents/guardians wish to register/admit/enroll their student(s) at a school other than the designated school that is in their attendance area outside of their district.
California Education Codesections 46600-46601(Outside Source) permits parents/guardians to request an interdistrict transfer/reciprocal agreement. The fundamental basis for this provision is the signing of an agreement between districts. Interdistrict transfer/reciprocal agreement must be approved by both the student’s original district of residence and the district to which the student seeks to transfer to. Both districts must approve the agreement before it becomes valid. The agreement may extend for a maximum of five consecutive years and may include terms or conditions. It is within the authority of either the home district or the receiving district to revoke an interdistrict transfer/reciprocal agreement at any time for any reason the local board or district superintendent deems appropriate.
If a request for an interdistrict transfer/reciprocal agreement is denied, the student’s parents/guardians may file an appeal to the county office of education in the student’s district of residence within 30 days of receipt of the official notice of denial of the transfer.
Interdistrict Transfer Because of Parent Employment/Allen Bill
California Education CodeSection 48204(b)(Outside Source) permits a school district to deem a pupil to have complied with the residency requirements for school attendance in the district if at least one parent/guardian of the pupil is physically employed within the boundaries of that district. Once admitted to residency, the pupil’s transfer may be revoked only if the parent ceases to be employed within the boundaries of the district. As a resident, the student does not have to re-apply for the transfer to be valid.
PROCEDURES
- To begin the transfer process, begin at your school of residence, which is based on your current physical address.
- Request and complete to Inter-District Transfer Request Form. Leave it at your district of residence office for approval/denial.
- You cannot attend the requested district until the receiving district has received a signed copy of the approved form from the sending district.
- Some districts may place restrictions on the number of transfers allowed. Contact the district office for more information.
Protocols
The following protocols will be used to handle non-special education interdistrict transfers in Siskiyou County:
- Any Interdistrict Transfer Request must be approved by both districts in the following sequence:
- 1st by the District of Residence (sending) and
- 2nd by the Requested District of Attendance (receiving) in this order.
- Request to change schools during a school year
When a student, who is currently enrolled in a school within the District of Residence, requests an interdistrict transfer, the following procedures and timelines will be followed:
- The District of Residence will provide the parent with the Request for Interdistrict Transfer form and will help them complete the form if necessary. Once completed, the parent will submit the form to the District of Residence for consideration of approval.
- The District of Residence will Time and Date Stamp the form and give the parent a copy.
- The District of Residence will have three (3) school days to complete and return the form to the parent.
- If the student has attendance, behavior, and/or academic concerns the District of Residence, will check the Conditional Approval box alerting the Requested District of Attendance that it should be diligent to review with the student and family its requirements and terms for accepting and maintaining interdistrict approval.
- If no action has been taken after three (3) school days, the parent may proceed on their own to seek consideration of approval to attend the Requested District of Attendance.
- The Requested District of Attendance, upon receipt of the form, will Time and Date Stamp the form and will have three (3) school days to consider approval.
- If the Request for Interdistrict Transfer form is approved by both the District of Residence and the Requested District of Attendance, the student is enrolled as soon as possible into the Requested District of Attendance.
- If the Request for Interdistrict Transfer form is denied by either or both the District of Residence and the Requested District of Attendance, the parent may appeal to the Siskiyou County Board of Education within 30 days of denial.

- Moving into the area during the school year
When a student who is not currently enrolled in any school within the area attempts to enroll outside their District of Residence, the following procedures and timelines will be followed:

- The student shall be sent to the District of Residence who will provide the parent with the Request for Interdistrict Transfer form and will help them complete the form if necessary. Once completed, the parent will submit the form to the District of Residence for consideration of approval.
- The District of Residence will Time and Date Stamp the form and give the parent a copy.
- The District of Residence will have three (3) school days to complete and return the form to the parent.
- If the student has attendance, behavior, and/or academic concerns the District of Residence, will check the Conditional Approval box alerting the Requested District of Attendance that it should be diligent to review with the student and family its requirements and terms for accepting and maintaining interdistrict approval.

- Requesting an interdistrict transfer for the next school year
When a student requests an interdistrict transfer for the next school year, the District of Residence and the
Requested District of Attendance both have 30 days to consider the request for transfer. Depending on the circumstance, the procedures in either number 2 or 3 above will be followed with the exception of three (3) school days for signoff and enrollment as soon as possible. Students will not be enrolled until a Request for Interdistrict Transfer form has been signed off by both districts.
- Because of space and program limitations, receiving districts may limit the total number of students they will receive.
- Acceptance of students may be based on behavior, academic standing, and attendance (refer to Requested District of Attendance Board policy).
- Students will be expected to meet academic and behavior standards upon entry and anytime following approval by the Requested District of Attendance. In the event there is reason to revoke a Request for Interdistrict Transfer, if possible and determined by the district as appropriate, the Requested District of Attendance will strive to do so at the end of a grading period.
- Education Code Section 46601 provides for appeal to the Siskiyou County Board of Education by the person having legal custody of a student within 30 calendar days of a Request for Interdistrict Transfer failing to be approved by either the District of Residence or the Requested District of Attendance.

Interdistrict Transfer Agreement
The following conditions govern inter-district agreements in Siskiyou County:
- Request must be approved by both the District of Residence and District of Attendance, in that order.
- District of Residence may choose to limit the number of children leaving their district.
- Due to space and program limitations, District of Attendance (receiving districts) may limit the total number of students they will receive.
- Acceptance of students cannot be based on academic skills or athletic ability. Selection shall be determined on first come, first served basis.
- First priority of attendance will go to those students residing within district boundaries.
- Priority consideration will be given to the sibling of current students.
- Students will be expected to meet district attendance, academic and behavior standards.
- Ed. Code Section 46601 provides for appeal to the County Board of Education by the person having legal custody of pupils, within 30 days of requested inter-district agreement failing to be approved by either school district.
Hornbrook Elementary School reserves the right to revoke an inter-district agreement of any transfer student, including those who are recommended for expulsion pursuant to Ed. Code 48018.
The Board of Trustees expects the following conditions of enrollment will be met by student(s):
- Attendance Requirement: In order for your child to be successful he/she must attend school regularly and be on time. If your child is tardy three (3) times, or misses more than four (4) days in a quarter, a meeting will be held to review the reasons. At that time a decision will be rendered to extend or revoke this contract.
- Behavior Requirements: Hornbrook Elementary School is a safe place for students to learn and we have a Discipline Policy in place that makes sure it remains a safe environment. Our student handbook clearly explains the expectations we have for our students and also contains a Code of Conduct Discipline Matrix which explains the consequences for any unacceptable behavior. If your child is suspended for any reason, a meeting will be held to discuss the appropriateness of the placement of your child at this school. A second suspension will be grounds for the immediate revocation of the interdistrict agreement.
- Academic Requirements: The student must maintain a cumulative Grade Point Average (GPA) of 2.0 or satisfactory progress for TK-3 students. When a student’s GPA falls below 2.0, a meeting will be held and a decision by the District will be made to extend or revoke this contract.
If the Board determines that excess costs would be incurred by the district, the student transfer will be either denied or nullified. Verification, by the Superintendent/Principal, of non-compliance of any of these expectations will nullify the transfer agreement.
